Consumer Protection

There is Legislation that provides consumers with additional protection in addition to the protection provided under the common law, particularly under contract law.

Legislation such as:

  • The Fair Trading Act
  • The Contracts Review Act
  • The Competition and Consumer Act (i.e. the former Trade Practices Act)

addresses issues like seen needs to :

  • Imply statutory warranties and provisions into particular contracts
  • Provide remedies for particular prohibited conduct

There is also a recently implemented prohibition of unfair terms.

Often parties have a remedy under consumer protection legislation:

  • Separately and in addition to any remedy they may have under a contract;
  • Even when they appear to have no remedy under the actual contract with the other party.
